Without going into the specifics of the situation, because I do not know the exact law of DC on the topic, I am willing to bet that a restaurant owner has the right to stop the publication of photos taken of food in her restaurant under the right of publicity. There is an exception under the 1st Am. of that little document on display at the Archives for news purposes but bloggers tend to not want to be journalists so the exception wouldn't apply. And even if you are a journalist I think there are limits as to what "news" is. Years ago it was pretty common for photographers to take pictures of inanimate objects for all kinds of purposes, including art, without getting the permission of the owner of the inanimate object. Now, it is recognized that obtaining the consent of the owner of the owner of the inanimate object is required and avoids potentially expensive litigation. Have you ever read the back of a ticket for a game at the MCI Center or any other venue. You should. Not only do you release the owner of the venue and teams from liability for most injuries as you have "assumed the risk" that you can get hit by an errant basketball, baseball and the occassional bat. You also grant the venue (as copyright owner) a license to your image for use on the jumbotron and broadcast on television. And, yes performance artists have the exclusive rights provided under the copyright act.
  2. Wow... I was thinking later down the road. I need to recover from the excesses of New Years, the Holidays and Tempt Asian before a hedonistic night at Bombay.
  3. So, I am going to post my evening here first and then it can be moved if appropriate...We went to Iota for New Years Eve which was great for me because it is in my neighborhood. Better for me because the food is soo good and reasonably priced. They had a limited menu that still offered plenty of choices for the diner. One soup (a play on onion soup), two salads (one spinach and one mixed greens), two appetizers (crabcakes and a fall roasted veggie wonton thing), five entree choices (two fish entrees, one veggie entree, one pork entree and a filet) and three desserts (a creme brulee, a poached pear and a deconstructed cheesecake sundae). I was impressed with the menu. We had the crabcakes and a green salad. The crabcakes were all crab. The sauces were really flavorful. I did not like the salad because I forgot to order the dressing on the side. I don't use much dressing so on the side is always better. For our main courses we split the salmon dish and the filet. The salmon was perfectly cooked, not sure if it was poached or baked. The sides were a beet salad and a potato latke. Both great renditions. The filet was yummy. For someone who just started eating red meat again, I have jumped in with both feet!!! The filet was served with crispy onions and roasted new potatoes. The onions were so good. Between our main course and dessert we had a port. It was my first port and it was good. I can see developing a taste for ports the same way I like rieslings in the summer... nice alternative to dessert in the summer (ports for the winter). But considering it was New Years, we had desserts. The creme brulee was very light and though called an eggnog brulee, we couldn't taste it. The chocolate cheesecake sundae was also light, and really chcocolately enough. Not a huge cheesecake fan but it was good. I have decided that Iota is a more rustic version of Corduroy. That is the quality of the food is as good as Corduroy but served in a less formal manner because it is a restaurant attached to a music venue. Happy New Year....

  5. I don't understand why nursing moms often don't use a blanket to cover the act. It may be very natural to nurse a child but I think it is appropriate to use some decorum when nursing.

  7. I did not like the Modern. The cafe would be fine. I'd go for tea or late afternoon snack and not a meal. On another note, the cafe looked fine BUT what kids young and old really like is the cafeteria at the Met. It is AMAZING and fun. Plus, I like the Met more than the MoMA and so would your 6 year old. Sounds like a great trip.

  9. I was there tonight too! The duck was amazing. The leg portion was like butter. I tell you, butter... and the sauce with bits of fig... yum....Our meal consisted of: the buffalo porcupine the spring rolls muscovy duck the roast chicken blackberry sorbet the saboynne (sp?) Happy. Very... This place is a gem. We got a lot of work done and had a great meal. And I now understand the Slow Food movement!

  11. So tonight I picked up from Thai Square. I perused the menu and decided to definitely get something I can't cook at home. So, Crispy Duck with honey and basil was in order. Am I crazy. It was good but I can feel my arteries going into toxic shock. Fried duck... can you imagine anything more unhealthy!!!! At least I put the duck on the salad instead of the rice. Weird yummy habit... And you?

Have to go to Colorado Kitchen before you go. All those American comfort foods that you will long for are done really well at CK. Do a brunch and dinner. Heck, I'd go for a burger night too... The bar at Corduroy is a nice way to spend an evening.
  13. Hey, I am one of those people... I do live in a boring apartment. But I have taste and my taste does not include CakeLove. Give me better please. Of course, the nice thing is that I won't be tempted or interested in the place so my body will be grateful. Hmmm...

  15. Mark Bittman's cookbook "How to Cook Everything" could be the only cookbook in my collection. The year I discovered it (I think 2002) I gave it to everybody for the holidays. It has become a staple gift for showers et al. The most ringing endorsement comes from my sister who rarely cooked or had a desire to step foot in the kitchen, she keeps Bittman's book by the stove and it is in constant use. I refer everybody to his brownie recipe, especially when told a mix has been used. I guess I should say why I like Bittman's work so much, he provides clear and concise recipes for good food whether simple or fancy. You can't go wrong with Mark Bittman. BTW, I discovered him through his cookbook on Fish. Before I found it fish scared me. Seriously....
  16. A friend in the real estate industry once told me that apartment density is necessary for restaurants to survive in a neighborhood. Apparently, (generally) people who own their own homes eat out once during the week and perhaps twice on the weekends. I can't remember the exact numbers but apartment dwellers eat out much more often. Plus in the suburbs you do not have business diners who support restaurants at night. Just my theories...

  18. I love Costco. When Costco and Sams were new, caterers were buying a ton of stuff at them and "prepping" them to look like the goods were "homemade." Caterers must have raked it in back then because they charged homemade prices. Also, I love platters from Chic-Filet (sp?)... well only the little nuggets... but they fly off the platter.
  19. Beware the gift certificate for cooking classes... I bought my mom one last year for Viking (she lives in a city with one of their schools) after she requested it. She still has not used it. I have to call and see if they'll extend the one year period.   20. Okay, I was wondering when I became one of those people who thought their kids were cute when fussy but others not so much. Then I realized that no, I was not one of those people. If I am with a baby/toddler who is not in the mood (is tired, hungry, bitter or in pain from teeth coming in), it is not the time for me to drag them into my world. Today at lunch the restaurant was teeming with babies. One was sitting at the very front of the restaurant. I was very far away, in the back. The baby cried, whined and otherwise made loud noises the entire lunch. I could hear that baby when I was in the ladies room. The other babies/toddlers were well behaved but it was clear that the little one up front just did not appreciate being away from the crib/jumper/whatever. I could not see but I never had the sense that an adult took the child out of the restaurant once. Sometimes adults have to change their plans when there are babies. I am not a bad person for wanting to enjoy my concert/movie/meal without the incessant crying of a child. Yes, I have thought about this issue quite a bit!!! :-)

  22. Okay that is a good name. I mean it doesn't indicate baking but come on.. it is very creative. I wonder if there are other dairy godmothers.... A note in the Oct. 25 WaPo says that the new name will be "That Custard Place in Del Ray." The winner got a year's worth of custard.
